Texas Rule of Civil Procedure 78a

 

Texas Rule of Civil Procedure 78a went into effect on September 1, 2010.  A civil case information sheet is now required for all new civil lawsuits and applications filed in the State of Texas.  Specifically, Rule 78a requires that the new civil case information sheet  must accompany the filing of an original petition and a post-judgment motion for modification or enforcement in a case filed under the Family Code.  Further, the civil case information sheet must be signed by the attorney for the party filing the pleading or by the party.

Rule 78a is added to require the submission of a civil case information sheet to collect data for statistical and administrative purposes.  A civil case information sheet is not a pleading.  When efiling, the case information sheet should be filed as an attachment NOT the lead document.
